I have the philosophy that art is meant to be seen and not hoarded. I also believe commercial entities shouldn't be able to monetise my work without my express permission. All rights to use any of my images are reserved. They cannot be used without express permission from me, for any reason, as stipulated in International, EU and UK Copyright law.
I do not offer my work for commercial use. ‘Commercial Use’ regarding the use of images online or offline is defined very broadly. The determination of commercial or non-commercial use is based on the contextual use of the image. The determination is NOT based on the tax-filing status of the entity using the image nor on whether or not a financial transaction takes place.
Examples of commercial use include but are not limited to:
A marketing campaign for a commercial entity
A fund-raising campaign for a not-for profit entity (*see below)
A background image for a website about tourism
License to create an individual print for use in a private home
Licence to use for any news or editorial piece (**see below)
I am happy to allow individuals to use my images for personal use only. You must still obtain permission from me for each use of my work. Drop me a line and email@example.com
Examples of private use include but are not limited to:
Blog Post describing a trip to Cornwall, UK
A website for a school project about the use of light in art
An individual using an image as a desktop background for the computer monitor
Sharing to social media platforms within private, non commercial social media accounts.
* Charities and non profits Entities with a 'charitable status' cover a wide gamut. While most are worthy organisations some sadly are not. I would be delighted if a reputable charity asked to use any of my images and would almost certainly provide permission for free. But do please ask before using them at firstname.lastname@example.org
** News and media use I normally do not allow news organisations to use my images. However there are a very few news outlets that I do admire and support. So once again if you are a news or media outlet and want to use an image please ask at email@example.com
Also Many of the images were taken on private land, specifically National Trust Properties, English Heritage Sites and Wildlife Parks. No property releases have been signed for any of the images. Commercial use of images taken at these locations is strictly prohibited by the landowners, so the commercial use of these images will breach their own rights which they may enforce against you in court.
